The audit clearly shows the ghost of the Lane County land swap still haunts the fairgrounds in county government. The audit shows the fair board still owes over $130,000 to the county road fund as a result of the land swap. That's because the 30th Avenue property that the county traded for the Old Willamette Christian Center in the deal was originally purchased with money from the road fund. Since the Fair Board is not using the Christian Center for a road-related purpose, it has to repay the road fund for the cash value of the 30th Avenue property. In fact, under Oregon law, those details should have been taken care of before the land swap went through. But because of the rush, a number of legal requirements appeared to have been ignored, with county officials picking up the pieces later. On January 9, 1979, a full five months after the commissioners approved the land A memo from county council pointed to the problem of repaying the road fund. The proposed solution involved a complicated internal county land transfer with the balance to be paid in cash by the Fair Board. There was still one problem. Oregon law requires that money loaned from one government fund to another be repaid by the end of the following year. A new audit clearly shows that in this case, the money won't be repayed until 1988, a full 10 years after the land swap took place. County officials say they found another statute that allows them to sell county land on long-term installments, but even that law requires such sales to be to the highest and best bidder. There were clearly no bidders in the Lane County land swap. County Council Terry Wilson tells us she's satisfied the payback plan is legal, but she also admits she had some difficulty drawing the line between a loan and a long- term payment plan. Attorney General Dave Frohmeyer tells us it may take an official legal opinion to sort that difference out.
