This after the jury heard testimony that Diane Downs had freely given her written and verbal permission to have her home searched for evidence. Shortly afterward, Lane County Deputy Sheriff Wayne Tracy took the stand. Under cross-examination, he was asked about the time he spent between the initial search of the Q Street home to obtain the rifle and the second search occurring later that day, the day after the shooting. Tracy was unable to document his actions during those several hours. Tracy replied, That's a lie. Downs defense noted that two of the eight rounds submitted as evidence were of a different type than the majority of the bullets. Also introduced as evidence today several items of bloodstained clothes, items taken from the hospital Gurney's where the children were put after the shooting. One by one, the items, more than a dozen were displayed to the jury by Deputy Sheriff Roy Pond. Some of the blood-soaked items brought audible gas from the spectators in the courtroom. Also testifying today, Stephen Downs, Diane Downes' ex-husband and father of most of her children. Under prosecution questioning, Stephen Downes recounted the couple's early years together, the birth of their children, an abortion, his vasectomy, the birth of a child not his own, the discovery of Diane in bed with the father of Danny, and her plans for surrogate motherhood. He also spoke of a threatened suicide on her part and her threat to kill him once with a 22 caliber pistol, a threat that Stephen Downes said he was able to defuse. He also recounted another incident in which he said Diane, seated in a car, pointed a gun at him. She has said it was not a gun, but a shoe. Today, Stephen Downes said it was definitely a gun. Stephen Downes' testimony is expected to continue tomorrow. It's much more difficult to cut wages than it is not to pay the bonus. And that element of flexibility is very important. There are others. The Japanese make maximum use of contractors. I left my heart there. I left most of my money there too, unfortunately. Had a real good time checking out some gourmet products and some fruits and vegetables down there. And California is the big story as the California tree fruit season begins. Peaches, plums, nectarines, cherries, all coming in right now. Starting out with peaches, all the fruit's gonna be a little high right now. I told you a few for the past few weeks that they've had some weather problems. Tree fruit was ripening prematurely. So prices on this items are gonna run about a dollar a pound and up. What this can mean to us locally though is that when our tree fruit season comes on, later on in the year, month or so, the farmers here will be able to get more money for their products, thus more local money in the local economy. So these higher prices can in the long run be actually good. Some new things out of California again, seedless grapes coming in now, about a dollar and a half a pound. Strawberries, an excellent buy, they remain very reasonable at 49, 69 cents a basket. Melons, cantaloupes, and honeydews coming in strongly right now. Even some early watermelons that have been so so, they will get better. Valencia orange is about 59 cents a pound, they're gonna stay up high. A new fruit item out of New Zealand, if you want a really fresh apple, the Granny Smith apple out of New Zealand is the only true fresh apple. They're having their fall now. Their seasons are kind of the opposite of what we have. Over in the vegetable department, again, California is a big story. Of course, locally we're getting some salad greens, radishes, and green onions, the end of asparagus season. But out of California, onions, tomatoes, potatoes. Zucchini, eggplant, everything is really coming on strong there. New item of the week, sweet corn out of California, three or four for a dollar, and haas avocados, back in season again, very strong, two or three for a dollar, very nice. So if you have any money left over, spend it on produce. An evaluation matrix was developed by the Oregon Productivity Center located at OSU. The matrix has categories for teaching, research, scholarship, and service. Each category has subdivisions, and each subdivision is weighted for importance according to input provided by faculty committees. Professors rate their performance in each subdivision on a scale of zero to ten. They are also evaluated by their department heads. Differing opinions are resolved at an annual review meeting between the two. A yearly review of faculty has been a policy since 1972. Like the matrix, it has included student, supervisor, and peer evaluations. What the matrix does differently, however, is to assign a measurable, precise, and weighted value to each job responsibility.
