Kutchar's defense attorneys argued that it was anything but a simple, case that, in fact, it was a complex case involving symbolic and political speech. When Kutcher took the stand this afternoon... He testified that he was attempting to make a strong political statement through his participation in the demonstration and in giving his name as Steve Biko when arrested. Steve Bico was a student leader in the South African movement against apartheid before his death. Cutter's attorneys contend that using that name was a continuation of the protest, that it was a political statement, and therefore protected by the Constitution. The prosecutor argued that it was simply a false statement given to the police. This trial will be completed tomorrow morning. Whether Kutcher is convicted may hinge on the judge's instructions to the jury. If he rules that it's a narrow case of trespassing and the truth or falsity of Kutchers statements to police, those facts have not been disputed. But if he allows the jury to consider issues of political speech and symbolic speech, the verdict is less certain. And rulings in this case may set a precedent for how the city handles the cases of the other protesters yet to come to trial. Zelaya told Oregon State Police Trooper Tom Dixon he shot 26-year-old Dwayne Denny and tried to kill 27-year old Evelyn Rogers after a drug argument, saying, once I started firing, I didn't see anything else. The only thing I saw was enemies. Zelaya explained shooting the two adults on tape, saying any man would have killed those people for getting in his so-called space. But Zelaya couldn't seem to explain, rationalize, or otherwise justify shooting the little boy. Seven-year-old Kenneth Rogers, who was waiting in the car while his mother and boyfriend were shot inside the Zelaya residence. Zelaya said on tape he had no choice but to kill the boy. Kenneth Rogers was shot three times, execution style. The defendant claimed he couldn't remember how the boy died, saying, I just remember going bang, bang, and the boy ended up dead too. But Zelaya was in a quandary about what to do with a carload of dead people sitting in their own blood. The trooper asked if they were heavy. Zelaya replied, like rubber. He admitted driving the bodies to a remote logging road 10 miles from the shooting site and leaving the three victims for dead, hoping they wouldn't be discovered till spring.
