What that means is the state will ask the court to order McNutt to reverse the effects of certain actions he's taken on and around his Mackenzie River Island. According to Earl Johnson, the Deputy Director of the State Lands Division, those include dirt that has been dumped over the bank in the north channel of the river, the digging of an artificial channel in the center of the island, an excavated inlet on the side of the island, and the filling of a high water channel. Johnson had previously told us the state might try to press criminal charges against McNutt. But Deputy Attorney General Martha Pagel now says that would have to be done through the Lane County District Attorney's Office. Pagel tells us that is still a possibility, but the first step will be to press the civil complaint in Lane County Circuit Court.
