Still, to coin a cliché, there are no easy solutions to this issue. And there's a good chance Terry James White, her alleged accomplice, will be tried here too. Both Harris and White claim the media's coverage of the just completed trial of Michael Dale Kell could prejudice their own trials. Because their situations are so similar, their trial judges Maurice Merton and James Hargreaves held an unusual joint hearing. Harris' attorney Bob Ackerman argued that because her trial was set to follow immediately after the Kell conviction, it was unlikely they could find a fair and impartial jury. White's attorney Alex Wold pointed to what he called the sheer volume of coverage bombarding the public on local radio and television and in the newspapers. But both lawyers agreed with Judge Merton, who said the reporting was, in his words, factual, non-inflammatory, and restricted to admissible evidence. And in the end, the judge agreed with prosecutor Brian Barnes, who asked the judge to try to choose a good jury before resorting to the added expense of moving the case out of town. Merton denied the motion for Barbara Harris, but he said he'll take another look at it after the jury selection process itself is given a fair chance. Judge Hargreaves said he would not rule in the White case until the Harris trial has run its course. He'll then listen to the defense one more time.
