What it says is, by law, that the governor does not have to spend all that the legislature appropriates to an agency. In other words, under Oregon law, an agency's not entitled to two million dollars just because the appropriation says that. That's the maximum that it gets. The allottment system's like a bunch of little spigots if you want to think about it like that. The governor can a lot less than the fractional share that's due. To affect savings, to improve management, or to prevent a deficit. That's what the law says. Now, our opinion is very important in this regard because it goes back to what the words of the law say, and it does depart from the three opinions of the Attorney General's office about 20 years ago by saying this. First of all, that the allotments don't have to be cut across the board. That is 10% from every agency, whether they can really afford to take that kind of loss or not. Can take 8 from one, 12 from another, nothing from a third, depending upon what seems fair and just. The second thing we say is that the governor can make those cuts selectively by program within an agency, rather than just saying, agency X, you take 10%, but I can't tell you where it's going to come from. And the third thing that our opinion discovers is that law is quite clear that the property tax relief fund and basic school support fund are also subject to this executive allotment system. So I suppose the impact of this opinion is to give the governor far greater authority than people had thought for many, many years that the governor had in the budget reduction process. It's not a separation of powers issue in the sense that the legislature gave the governor this authority, and the legislature could obviously withdraw it. So you have a very powerful restraining device, which is that the governor has got to be able take the heat for an unpopular budget cutting decision. And secondly, the governor is got to recognize, and I'm sure would recognize, that if he or she abuses that power, then the legislature in the next session is very likely to take it away by abolishing that allotment system altogether.
