Wood has been convicted of official misconduct and perjury for his role in a 1978 Lane County land swap. That trade realized a half million dollar profit for two of Wood's political contributors, Mike Safley and the late Al Phelps. Wood could be sentenced to five years in prison for perjuring and another year for misconduct. Following his conviction in October, officials of the State Parole Office began a detailed pre-sentence investigation. That report was returned to Lane County Circuit Court Judge Maurice Merton and both the prosecution and defense in December. Now learned that information from Wood's former employers at the Los Angeles Fire Department and the Eugene School District was favorable to Wood. Nevertheless, the report concludes that Wood should be sentenced to jail. None of the officials involved in preparing the report are allowed to reveal its contents And none of the principles will come in either. But the jail recommendation has been confirmed by a source close to Wood and an official who has seen it. Wood is now scheduled for sentencing on January 22nd. That will follow a hearing before Judge Merton on two motions to dismiss the verdicts against Wood. Those motions argue that the Lane County District Attorney violated court rules by holding a press conference immediately following the verdict, and also that the DA's office withheld some grand jury testimony that could have helped Wood's case. If Merton denies those motions, Wood will be sentenced and will have to decide whether to appeal his conviction. If he decides to appeal, it will cost Wood $7,500 to $10,000 just to order the transcripts from the 17-day trial.
