Defense attorney Kenneth Marl has attempted to find possible areas of prejudice on the part of the jurors. Many of his questions have focused on the issue of race, On the issue of interracial marriages. Brooks is black. All 18 women members of his communal family, the Children of the Valley of Life, are white. And attorney Marle said in court today that two of the children of those women were fathered by Brooks. All of the potential jurors are white also. And one who was questioned by Marle this morning said she did have very strong feelings about interracal marriages because of the effects they have on the children those marriages. Morrow has also asked questions about pretrial publicity and about people's attitudes on guns. Prosecutor Maurice Merton has questioned jurors mostly about their attitudes on the criminal justice system and on whether they might be prejudiced against police officers in general. The final jury may be chosen as early as tomorrow morning. If it is, the defense and prosecution will give their opening statements. Today's presentations in court were the first public indications as to exactly how Lane County Deputy Sheriff Roy Dirks met death last April 11 near Blue River. Prosecutor Maurice Merton was first to address the jury. Merton said the state will try to prove that Roy Dirkes went up Blue Mac Road not expecting to find Brooks and his family, that Deputy Dirkes was confronted by Brooks, that Brooks was holding a seven millimeter rifle and Belinda Lederer was holding a 30-odd .30 rifle. That Brooks told Deputy Dirks to get out of his car, that they argued much as they often did, that Deputy Dirk became nervous, pushed away the barrel of Brooks' rifle, made a motion toward his own gun, and that was when he was shot by Belinda Lederer. Merton told the jury, the state will contend that who pulled the trigger is irrelevant. He contended that Roy Dirks was a dead man when he got out of this car, and that Norman Brooks is criminally responsible for his death. Defense attorney Kenneth Morrow agreed with most of the facts as presented by Merton, but Morrow made it clear the defense's position will be that Norman Brooks had no intention of physically harming Roy Dirks, that he wasn't even aware of any motion Dirks made to draw his gun, that Brooks did often argue with Deputy Dirks but Brooks had never used violence against Dirks. Morrow went on to say that Brooks and the family moved Dirks' body after he was shot because they didn't want their children to see it. That they left the scene of the shooting because they were afraid they would be killed by the police in revenge. Morrow contended that Norman Brooks had no intention of killing Roy Dirks or of hindering the investigation of his shooting. This afternoon, prosecutor Merton called the first witnesses to the stand. They testified that Deputy Dirks went to Blue River on April 11th to investigate a drowning. Today's opening statements drew the lines of defense and prosecution. But the jury may hear more than a hundred witnesses before they get to decide whether Norman Brooks is guilty or not guilty.
