Last night, tests were conducted spraying methyl bromide gas on Douglas, Noble, and Grand Fir Trees as well as pine. But it will be three weeks before they know if the gas will kill the eggs without killing the trees. If it's successful, growers will bear the cost of fumigation when necessary. Inspections will be mandatory for all Christmas trees and wood products leaving the affected parts of Lane County. But those with household goods or recreational vehicles will be on the honor system to ask for an inspection before moving from the quarantined area. Twenty-year-old Kenneth Case, also of Junction City, had walked the elderly man home from the pumphouse tavern. He later beat him to death. Four days later, he was arrested. Today, Case agreed by stipulated facts that the Lane County Circuit Court would be able to find him guilty of murder. Based on those facts, the court did find him guilty, but ruled he couldn't be held responsible for his actions because of his mental capacities. In a letter from a psychiatrist, Case was diagnosed as being mentally ill the night he beat Irvin to death. Because of that illness, Circuit Court Judge Edwin Allen could not sentence him to prison. This morning, the defendant was committed to the Oregon State Hospital for life. He was also committed to a 20-year stint in the mental institution on a charge of burglary. Both of the offenses occurred three days after he was released from the state hospital in July. A Marion County judge had reluctantly released Case. The psychiatrist who testified at Case's July hearing said he did not have a mental disorder, but rather a personality anti-social disorder. For that reason, the hospital had to let him go. Case will now have to appear before the Psychiatric Review Board. It will be up to that board as to how long he actually has to stay in the hospital.
